Comment on BIA Proposed ICWA Guidelines

In the Federal Register on March 20, 2015, a Notice on Public Rulemaking regarding regulations guiding the application of the Indian Child Welfare Act (ICWA) for state courts and public and private agencies was published. As part of the notice and comment period the Bureau of Indian Affairs (BIA) is hosting a series of public hearings and consultations. The National Indian Child Welfare Association (NICWA) has prepared a sample comments leader for any ICWA advocate to use to send in their own comments.

The proposed ICWA rules represent a significant development in ICWA implementation and compliance. For example, the rules include examples for what would be considered "active efforts" for services to parents, which now includes Tribal Healing to Wellness Courts!

It is essential that we let our voices be heard.
